Agreement to Terms

By accessing and using Birthday Video Magic ("the Service"), you accept and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

Service Description

Birthday Video Magic provides AI-generated personalized birthday videos for children. The Service uses artificial intelligence to create custom animated videos featuring the child's name, age, and family members.

• All content is AI-generated and original
• No licensed characters or copyrighted content is used
• Videos are typically delivered within 4-6 minutes
• Video quality: 720p or 1080p in 16:9 or 9:16 aspect ratio

Pricing and Payment

• Current price: $12.99 USD per video
• Payment is processed securely through Stripe
• All sales are final once video generation begins
• Prices are subject to change with notice
• Refunds are provided only in cases of technical failure (see Refund Policy below)

Video Delivery and Storage

• Videos are delivered via email with a download link
• Download links expire after 7 days
• You must download your video within 7 days
• We cannot recover or regenerate deleted videos
• We are not responsible for videos not downloaded within the 7-day period
• No refunds will be issued for expired video links

User Responsibilities

By using the Service, you agree to:

• Provide accurate information for video generation
• Use the Service for lawful purposes only
• Not submit offensive, harmful, or inappropriate content
• Download your video within 7 days of creation
• Not attempt to reverse engineer or exploit the Service
• Be at least 18 years old or have parental/guardian consent
• Respect intellectual property rights

Intellectual Property Rights

Your Rights

Once payment is complete and the video is generated:

• You own the completed video for personal use
• You may share the video on social media with proper attribution
• You may use the video for non-commercial purposes

Restrictions

• You may not resell or commercially distribute the video
• You may not claim the video as your own creation
• You may not modify and resell the video
• The Service, technology, and branding remain our property

Refund Policy

Refunds are provided in the following cases:

• Technical Failure: If we are unable to generate your video due to technical issues
• Duplicate Charges: If you were charged multiple times for the same order
• Service Error: If the video contains significant errors we cannot fix

Refunds will NOT be provided for:

• User errors in provided information (wrong name, age, etc.)
• Stylistic preferences or subjective quality
• Expired download links (after 7 days)
• Change of mind after video generation begins

To request a refund, contact us at refund@videos.birthdayvideomagic.com within 24 hours of purchase with your order details.

Content Guidelines

We reserve the right to refuse service for requests that:

• Contain offensive, hateful, or discriminatory content
• Request copyrighted or trademarked characters
• Violate any laws or regulations
• Could harm children or promote unsafe behavior
• Are deemed inappropriate at our sole discretion

Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the Service
• We are not responsible for third-party service failures (Stripe, email delivery, etc.)
• We are not liable for videos not downloaded within the 7-day period

Service Availability

• We strive for 99.9% uptime but cannot guarantee uninterrupted service
• We may suspend the Service for maintenance with notice when possible
• Video generation times are estimates, not guarantees
• We reserve the right to modify or discontinue the Service at any time

Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

Termination

We reserve the right to suspend or terminate your access to the Service for violation of these Terms, fraudulent activity, or any reason at our sole discretion, with or without notice.

Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or a notice on our website. Continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts located in the jurisdiction where we are based.
